These Terms of Service govern access to the ClientStream website and application. By creating an account, using the service or purchasing a subscription, you agree to these terms. If you do not agree, do not use ClientStream.
1. About ClientStream
ClientStream is a client tracking and small-business administration tool designed to help users manage customer records, jobs, quotes, invoices, payments, expenses, reminders, follow-ups, review requests, communication drafts and basic business reports.
ClientStream is not accounting, tax, financial or legal advice and is not intended to replace professional services or legally required recordkeeping systems.
2. Eligibility and accounts
You must provide accurate account information and keep it current. You are responsible for activity under your account, protecting login credentials and ensuring that authorised users follow these terms.
You must notify us promptly if you suspect unauthorised access. ClientStream may suspend access where reasonably necessary to protect accounts, users or the service.
3. Free and Pro plans
ClientStream may offer a Free plan with usage limits and a paid Pro subscription. Current prices, limits and included features are displayed on the website or within the application and may be updated for future billing periods.
The currently advertised Pro price is $9.99 AUD per month. The Free plan currently advertises limits of 10 active clients, 10 issued invoices and 5 Smart Write drafts per month. Actual entitlement is determined by the current plan configuration in the application.
Reaching a Free plan limit may prevent creation of additional records while continuing to allow access to existing information, subject to reasonable technical and security restrictions.
4. Subscription billing
Paid subscriptions may be processed through PayPal or another clearly identified provider. By subscribing, you authorise recurring billing at the displayed interval until cancellation.
Taxes, provider fees and currency-conversion charges may apply depending on your location and payment account. Subscription access may be delayed or suspended if payment is pending, declined, reversed, disputed or cannot be verified.
5. Cancellation and plan changes
You may cancel a subscription using the available account or payment-provider controls. Cancellation normally prevents future renewals rather than refunding an already-paid billing period, unless required by law or stated otherwise.
When Pro access ends, existing records should remain available, but the account may return to Free plan limits. Features such as advanced reports, branding, delivery tools or new record creation beyond Free limits may be restricted.
6. Acceptable use
You must not use ClientStream to:
- break the law or infringe another person's rights;
- send spam, deceptive messages, harassment or unlawful marketing;
- store or distribute malicious code;
- attempt to access another user's account or data;
- probe, disrupt, overload or bypass service security;
- upload content you do not have permission to use;
- misrepresent generated documents, records or communications;
- resell or provide unauthorised access to the service.
7. Your business and client data
You retain your rights in information and materials you enter or upload. You grant ClientStream a limited licence to host, process, reproduce and transmit that content only as reasonably required to provide, secure and improve the service.
You are responsible for the accuracy, legality and retention of your business records and for having a lawful basis to store information about customers or other people.
8. Quotes, invoices and reports
ClientStream may generate quotes, invoices, payment records, estimates, summaries and exports based on information you provide. You must review documents before issuing or relying on them. You remain responsible for invoice numbering, GST treatment, payment details, legal disclosures, tax obligations and record accuracy.
Reports and profit estimates are informational and may be incomplete or affected by missing, incorrect or duplicated entries.
9. Smart Write and generated content
Smart Write and similar features assist with drafting. Generated text may be inaccurate, inappropriate or incomplete. You must review and approve content before sending, publishing or relying on it.
You must not use generated content to impersonate others, mislead customers, provide regulated professional advice without qualification, or violate intellectual-property, privacy or marketing laws.
10. Third-party services
ClientStream may rely on Replit, PayPal, authentication, email, artificial intelligence, analytics, file-storage and other external providers. Their services may be subject to separate terms, fees, outages and policies. ClientStream is not responsible for failures or changes outside our reasonable control.
11. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, updates, provider outages, security incidents and technical problems may affect access.
We may add, modify or remove features where reasonably necessary. We will try to avoid materially reducing paid functionality during an already-paid billing period without a reasonable operational, legal or security reason.
12. Backups and exports
ClientStream may use database backups and recovery processes, but you should keep appropriate copies or exports of business-critical information. Do not rely on ClientStream as the only copy of information you are legally required to retain.
13. Intellectual property
ClientStream and its software, branding, interface, documentation, templates and underlying systems are owned by ClientStream or its licensors. These terms give you a limited, revocable, non-exclusive right to use the service for your own lawful business purposes.
You may not copy, reverse engineer, scrape, reproduce, resell or create a competing service from protected parts of ClientStream except where permitted by law.
14. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable guarantees under the Australian Consumer Law.
15. Refunds
Refund requests are assessed under applicable law, the nature of the issue and the payment-provider process. Change-of-mind refunds are not guaranteed for subscription periods already provided. This does not affect non-excludable consumer rights.
16. Disclaimers
To the extent permitted by law, ClientStream is provided on an “as available” basis. We do not guarantee particular revenue, debt recovery, customer retention, reviews, tax outcomes, legal compliance or business results.
17. Limitation of liability
To the extent permitted by law, ClientStream is not liable for indirect or consequential loss, lost profits, lost opportunities, reputational damage, loss caused by incorrect user data, unauthorised account access caused by the user's actions, or failures of third-party services.
Where liability cannot be excluded but may be limited, our liability is limited, at our option, to resupplying the affected service, correcting the issue, or refunding the amount paid for the affected service period.
18. Suspension and termination
We may suspend or terminate access for serious or repeated breaches, unlawful activity, security threats, abuse, non-payment or conduct that risks harm to users or the service. Where reasonable, we will provide notice and an opportunity to export information before permanent closure, unless doing so would create legal or security risk.
19. Privacy
Personal information is handled under our Privacy Policy.
20. Changes to these terms
We may update these terms. The latest version will be posted here with a revised date. Continued use after an update takes effect indicates acceptance, subject to applicable law.
21. Governing law
These terms are governed by the laws of Tasmania, Australia, and applicable Commonwealth laws. Courts with jurisdiction in Tasmania may hear disputes, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
